I also prefer to document communications by email, as Russell Winslow (Interlock salesman) requested since the beginning of our interactions.The roof was installed on Dec 3+4, 2015.On 12/13/15, since the dumpster still sat in my driveway, I had to email Interlock to get them to remove the dumpster from my driveway. It was removed on 12/17/15.Forgetting that inspection was part part of the contract, I called the city inspector and he came out on 12/15/15. The inspection did not pass as the inspector did not have a permit number and needed specs for the roof.On 12/15/15 I emailed both Russell and Allen with a copy of the inspector’s note and asked what I should do. NO REPLY.On 12/30/15 I reread the contract, and found that the inspection and permit was expressly included in the agreement. I called the city and discovered that no permit had been issued.On 12/31/15, fearing that Interlock had skipped out out of town, I put a stop payment on one ($17,600) of the two checks that I used for final payment of the contract. (Neither of the checks had been cashed yet.) Since it had been over 2 weeks with no reply to my email, I could only assume that Interlock was never to be seen again, and they had breeched the contract, and left me with a likely failing roof. What respecting roofing company would “forget” to get a permit, AND “forget” to get it inspected?On 1/2/16 I emailed both Russell and Allen, reminding them that the inspection was part of the contract. I also asked about how long I was required to keep the “New Roof” sign up in my yard. I did not tell them I had engaged a stop payment, and I did not say that I knew there was no permit. NO REPLY.On 1/6/16 I purchased a permit. I didn’t want to be fined for Interlock’s neglegence. I consulted a lawyer. On 1/11/16 the stop payment check was posted unpayed.Now finally, on 1/15/16 I received a reply! I was asked about the returned check and what I wanted to do about it. No mention of my purchase of the roof permit, but Allen had scheduled a new roof inspection the following week, and will send me confirmation and the proper paperwork. No answer about how long I need to display the “New Roof” sign.On 1/15/16 I emailed both Allen and Russell, explaining the reasons for the stop payment, reminding them AGAIN that the inspection is required to fullfil the contract. My good faith had run out, and I no longer have any intention to prepay. As they have proven their inadequacy, I will finish payment when they have fullfilled the contract. I also revealed I had paid for the permit, and I will bededucting that from the final payment. I reiterated that throughout all this, all I want is a fair deal.On 1/16/16 I received an apology email from Russell.On 1/27/16 I received an confirmation email from Allen that the roof passed inspection. He also took the opportunity to apologize.On 1/30/16, after verification of the successful inspection, I sent the final payment, and emailed both Allen and Russell informing them of same. Additionally, I stated:Since you have neglected to answer my query about how long the "New Roof" sign needs to stay up, I have removed it. If it is supposed to stay up more than a month and a half, prove it. So I have your sign, and a tool left by the roofers (pic attached) ready to be picked up. Please reply, and inform me of your intentions regarding these items.Given that I have had to hound you to fulfill the contract requirements (a roofing permit(!) and pick up of the dumpster), and replies to my queries have been spotty at best, I would expect that such a simple reply request would be fairly prompt, but my expectations are low. Therefore, I am force to state that if you do not reply withing two weeks, I AM UNDER NO OBLIGATION TO RETURN OR RETAIN SAID ITEMS FOR YOUR RETRIEVAL.To this date, 2/25/16, there has been no reply (or communication) of any kind. I suppose I should have withheld the check until final clean up this April, as that is expressly stated in the contract, also. Again, all I want is a fair deal. Interlock will not release the written guarrantee until paid in full. In other words, I don’t even know what I am buying (except for what would be considered heresay in court). The payment remaining was sent on 1/30/16. It was cashed on 2/22/16. We’ll see if they actually send the guarantee without me pestering them AGAIN. All I want is a fair deal. Is that really such a difficult thing to expect?Richard Rodich
